Refer a Friend Programme Terms and Conditions

1. Agreement to Terms

1.1 Acceptance of Terms

The Guardians Tribe is a privately managed entity currently operated by its founders, Samantha and Nathan Marley. The platform is currently transitioning into a long-term private structure under its parent entity, Sovereign Ventures, which is being established to ensure lasting family control, integrity, and protection. This transition safeguards the platform from external ownership and keeps it aligned with its founding purpose and values.

Once complete, The Guardians Tribe will be permanently designated as a family-owned entity, meaning it cannot be bought, sold, or transferred outside of the Marley family lineage. This ensures that the legacy being built remains intact and can be passed through future generations with full continuity and care.

The Guardians Tribe operates two participation programmes within the platform: the Affiliate Programme, which allows approved members to earn commission for referring new members, and the Refer a Friend Programme, which provides a one-time shared reward when a member invites someone to join the Tribe.

By enrolling in either The Guardians Tribe Affiliate Programme or Refer a Friend Programme (collectively referred to as the “Programmes”), you agree to be bound by these Terms and Conditions. Participation in either programme signifies your acceptance of all provisions outlined herein.

Binding Agreement – Your enrolment in the Programmes constitutes a legally binding agreement between you and The Guardians Tribe.

Compliance Requirement – You must comply with all programme rules, policies, and applicable laws when participating.

Age & Eligibility – Participants must be at least 18 years old and legally capable of entering into this agreement.

Right to Modify Terms – The Guardians Tribe reserves the right to amend, update, or change these terms at any time without prior notice.

Continued Participation – Your continued involvement in the Programmes after changes to these Terms constitutes your acceptance of the revised terms.

1.2 Amendments & Notifications

No Obligation for Prior Notice – The Guardians Tribe may modify the terms of the Affiliate Programme and Refer a Friend Programme at any time without an obligation to provide advance notification.

User Responsibility to Stay Informed – Participants are encouraged to periodically review these Terms & Conditions to stay updated on any modifications.

Optional Withdrawal – If you do not agree to any future modifications, you must discontinue participation in the Programmes.

1.3 Termination of Participation

Voluntary Withdrawal – Participants may leave the Affiliate Programme or Refer a Friend Programme at any time by notifying The Guardians Tribe in writing.

Suspension for Non-Compliance – Failure to adhere to these Terms may result in suspension or termination from the Programmes.

Final Decision by The Guardians Tribe – All decisions regarding policy enforcement, amendments, suspensions, and terminations shall be at the sole discretion of The Guardians Tribe..

2. Eligibility

2.1 Eligibility Requirements

To participate in The Guardians Tribe Affiliate Programme or Refer a Friend Programme, you must:

Be at least 18 years old – Participants must be legally recognised adults capable of entering into a binding contract.

Reside in a legally permitted country – Participation is only available in regions where referral or commission-based participation is legally permitted.

Provide accurate and truthful information – Applicants to the Affiliate Programme must submit valid personal and/or business details during the application process. Members participating in the Refer a Friend Programme must ensure their account details are accurate and up to date.

Comply with all applicable laws and regulations – Participants are responsible for ensuring that their involvement does not violate local or international laws.

Agree to The Guardians Tribe’s Terms & Conditions – By applying to the Affiliate Programme or participating in the Refer a Friend Programme, members acknowledge their acceptance of these Terms and Conditions and all programme rules.

2.2 Application Review & Approval

This section applies to participation in The Guardians Tribe Affiliate Programme, which requires an application and approval before access to affiliate referral links and commission tracking is granted.

The Guardians Tribe reserves sole discretion – All Affiliate Programme applications will be reviewed, and acceptance is not guaranteed.

Incomplete or misleading applications may be denied – Providing false or incomplete information may result in rejection of the application or removal from the Affiliate Programme.

Periodic Eligibility Checks – The Guardians Tribe may conduct periodic reviews to ensure approved affiliates continue to meet the eligibility requirements of the programme.

Right to Terminate Participation – If an approved affiliate is later found to be ineligible or in breach of these Terms, The Guardians Tribe may suspend or terminate their participation in the Affiliate Programme without prior notice.

2.3 Maintaining Eligibility

Participants must ensure continued compliance with eligibility requirements while participating in the Affiliate Programme or Refer a Friend Programme, including:

Updating personal or business information – Changes to contact details, payment information, or residency status must be reported promptly to ensure accurate records.

Adhering to all legal and ethical standards – Participants must not engage in fraudulent, deceptive, or misleading practices while participating in the Programmes.

Maintaining active and compliant accounts – Accounts participating in the Affiliate Programme must remain active and in good standing. Accounts deemed inactive for extended periods or found to be in breach of these Terms may be subject to review, suspension, or removal from the programme.

3. Responsibilities of Members

All participating members are responsible for the following while taking part in The Guardians Tribe Affiliate Programme or Refer a Friend Programme:

Promoting The Guardians Tribe services honestly and ethically – When sharing The Guardians Tribe (including Homeowner, Guardian, and Dual memberships), members must do so in a truthful and responsible manner.

Refraining from making false or misleading claims – Members must not make inaccurate or misleading statements about The Guardians Tribe, its services, the Affiliate Programme, or the Refer a Friend Programme.

Respecting intellectual property rights – Members must only use official and approved marketing materials provided by The Guardians Tribe and must not alter or misuse brand assets.

Maintaining confidentiality – Members must respect and protect any proprietary or confidential information provided by The Guardians Tribe.

4. Prohibited Activities

The Guardians Tribe maintains strict ethical and operational standards to ensure fairness, transparency, and integrity across both the Affiliate Programme and the Refer a Friend Programme. The following activities are strictly prohibited, and violations may result in suspension or termination from participation in the Programmes.

4.1 Prohibited Conduct

Members participating in the Affiliate Programme or Refer a Friend Programme must not:

Engage in spam or unsolicited promotional activity – Including mass email campaigns, unsolicited messages, or intrusive promotional tactics.

Use deceptive or unethical methods – Members must not use misleading tactics to recruit individuals or promote The Guardians Tribe memberships.

Misrepresent their affiliation – Members must not falsely claim to be employees, partners, or official representatives of The Guardians Tribe.

Engage in activities that harm the reputation of The Guardians Tribe – Any behaviour that damages the integrity or public perception of the platform may result in removal from the programme.

Create or stack multiple accounts – Members must not create or manipulate multiple accounts for the purpose of earning additional commissions, rewards, or referral credits.

4.2 Allowable Household Accounts

Multiple members of the same household who are over 18 years of age may participate in the Affiliate Programme or Refer a Friend Programme individually, provided that:

Each member maintains their own unique account – This includes a separate email address, account login, and payment details where applicable.

Accounts must be used independently – Household accounts must not be created or manipulated for the purpose of generating additional commissions, rewards, or referral credits.

No self-referrals or circular referrals – Members within the same household may not refer each other’s accounts for the purpose of earning commissions or referral rewards.

4.3 Consequences of Violating These Policies

Violations of these Terms or Programme policies may result in one or more of the following actions:

Suspension of account privileges – Temporary restriction of access to the Affiliate Programme or Refer a Friend Programme while the issue is reviewed.

Forfeiture of earnings or rewards – Any unpaid commissions, referral rewards, or membership credits may be withheld or revoked.

Permanent termination from the Programmes – Members may be permanently removed from participation in the Affiliate Programme and/or Refer a Friend Programme.

Legal action if necessary – The Guardians Tribe reserves the right to pursue legal remedies where fraudulent, deceptive, or unlawful behaviour has occurred.

5. Commission Structure

The Guardians Tribe operates two separate sharing programmes: the Affiliate Programme and the Refer a Friend Programme. These programmes allow members to introduce others to the Tribe while receiving recognition or rewards for successful referrals.

The Affiliate Programme allows approved members to earn commission by referring new members to The Guardians Tribe through their personal referral link.

The Refer a Friend Programme allows members to casually invite friends to join the Tribe without becoming affiliates. When a referral is successful, the reward is shared between both members.

Both programmes apply to successful referrals of Homeowner, Guardian, and Dual memberships.

The Guardians Tribe reserves the right to update, modify, or discontinue any aspect of these programmes at its sole discretion in order to maintain fairness, sustainability, and operational integrity.

5.1 Commission Model Overview

The Guardians Tribe offers two participation programmes for members who wish to introduce others to the platform: the Affiliate Programme and the Refer a Friend Programme.

Affiliate Programme – Approved affiliates may earn commission by referring new members to The Guardians Tribe through their personal referral link.

Refer a Friend Programme – Members who do not wish to become affiliates may invite friends using their personal referral link. When a successful referral occurs, the reward is shared between both members in the form of a membership discount for the new member and membership credit for the referring member.

Subject to Change – The Guardians Tribe reserves the right to revise programme structures, commission rates, rewards, or eligibility criteria at any time to ensure fairness and sustainability.

Referral-Based Recognition – Earnings, rewards, or credits are only granted when a new membership is successfully completed through a valid referral link.

5.2 Affiliate Commission Structure

The Guardians Tribe Affiliate Programme operates on a single-level commission model.

Approved affiliates earn 20% commission on every membership purchased through their personal referral link, including Homeowner, Guardian, and Dual memberships.

Direct Referral Commission – Affiliates receive 20% commission on each successful membership purchase made through their referral link.

Recurring Commission – If a referred member renews their membership in future years, the affiliate will continue to receive 20% commission on each renewal payment for as long as that member remains active.

This structure allows affiliates to earn ongoing income by introducing new members to The Guardians Tribe.

5.3 Refer a Friend Programme

The Refer a Friend Programme allows members to invite friends to join The Guardians Tribe without becoming affiliates.

When a new member joins using a valid referral link:

  • The new member receives a 10% discount on their membership
    • The referring member receives 10% membership credit of the same value

Refer a Friend rewards are one-time only and apply only to the initial membership purchase. These rewards do not repeat on membership renewals.

Refer a Friend rewards cannot be combined with public promotional offers and are not valid during promotional periods.

5.4 Commission Payouts & Conditions

Commission Tracking

All affiliate commissions are tracked automatically through The Guardians Tribe referral system. Commissions are only eligible for payout once the applicable cooling-off period has fully passed and the commission has been marked as approved within the system.

Approved commissions will appear in the affiliate dashboard and remain pending until the transaction has cleared the cooling-off period and all payment conditions have been satisfied.

Affiliate Commission Payouts

Affiliate commissions are paid once per month via our payment partner Wise. All approved commissions available at the time of the monthly payout will be processed and paid on the 15th of each month to the Wise account email provided by the affiliate.

Affiliates are responsible for ensuring that their Wise payment details are accurate and up to date within their affiliate dashboard.

Refer a Friend Rewards

Rewards earned through the Refer a Friend Programme are issued as membership credit and are not paid as cash commissions. Membership credits may only be applied toward future membership renewals and cannot be exchanged or withdrawn as cash.

Refer a Friend rewards are one-time only per successful referral and do not apply to future membership renewals.

Payment Schedule

Affiliate commissions are paid automatically once per month via our payment partner Wise. All approved commissions visible in an affiliate’s balance at the time of the monthly payout will be included in that payment. Payouts are processed on the 15th of each month.

Minimum Payout Threshold

There is no minimum payout threshold. Affiliates are paid whatever approved commission balance is available at the time of the monthly payout.

Payment Methods

All affiliate commissions are paid via Wise. Affiliates must provide a valid Wise account email address within their affiliate dashboard in order to receive payouts. Members are responsible for ensuring their payout details remain accurate and up to date.

Refund & Chargeback Adjustments

If a referred membership is refunded, cancelled, or charged back after a commission has already been paid, the corresponding commission amount will be deducted from the affiliate’s next payout. This ensures commissions are only paid on successful and completed transactions.

5.5 Compliance & Programme Integrity

To maintain fairness and prevent abuse of the Affiliate Programme and Refer a Friend Programme, the following rules apply:

Self-referrals are not permitted – Members may not earn commissions, referral rewards, or membership credits on their own membership purchases.

Fraudulent or deceptive practices are prohibited – Any attempt to manipulate or abuse the referral system, including creating fake referrals, duplicate accounts, or misleading promotions, may result in suspension or permanent removal from the programmes.

Inactive affiliate accounts – Affiliate accounts that remain inactive for extended periods may be reviewed, and any unpaid commissions may be forfeited at the discretion of The Guardians Tribe.

6 Payment Terms

The Guardians Tribe Affiliate Programme is designed to provide clear, predictable, and transparent commission payments. Affiliate commissions are tracked automatically through the referral system and paid on a fixed monthly schedule once all eligibility conditions have been met.

Payments apply only to approved commissions earned through the Affiliate Programme. Rewards earned through the Refer a Friend Programme are issued as membership credit and are not paid as cash commissions.

6.1 Commission Calculation & Account Crediting

Commission Calculation
Affiliate commissions are automatically calculated and credited to the affiliate’s account when a successful referral is recorded through their personal referral link.

Transaction Verification
All commissions are subject to verification. Referred memberships must remain valid, active, and not subject to refunds, cancellations, or chargebacks during the applicable cooling-off period before commissions are approved for payout.

System Adjustments

The commission system operates automatically. Manual adjustments may be made only where necessary to correct technical errors, resolve confirmed discrepancies, or address system-related issues.

6.2 Minimum Payout Threshold & Withdrawal Eligibility

No Minimum Payout Threshold
There is no minimum payout amount. Affiliates are paid whatever approved commission balance is available at the time of the monthly payout.

Approved Balance Only
Only commissions marked as approved are eligible for payout. Pending commissions will automatically roll into future payout cycles once approved.

Negative Balances
If a refund or chargeback occurs after a commission has been paid, the corresponding commission amount will be deducted from the affiliate’s next payout. If no new commissions are earned, the balance will carry forward until the amount has been offset.

6.3 Payment Methods & Bank Details

Payout Method
All affiliate commissions are paid via Wise. Affiliates must provide a valid Wise account email address within their affiliate dashboard in order to receive payouts.

Payment Information Accuracy
Affiliates are responsible for ensuring their Wise payout email address is accurate and kept up to date. The Guardians Tribe is not responsible for failed or delayed payments caused by incorrect or outdated payout details.

Currency
Commissions are calculated in GBP. Any currency conversion fees or charges applied by Wise are the responsibility of the recipient.

6.4 Payment Schedule & Processing Time

Monthly Payouts
Affiliate commission payouts are processed automatically once per month via Wise. All approved commissions visible in an affiliate’s balance at the time of the payout will be included in that payment. Payouts are processed on the 15th of each month.

No Withdrawal Requests
Affiliates do not need to request withdrawals. Payouts are processed automatically as part of the monthly payout cycle once commissions have been approved.

Tax Responsibilities
Affiliates are solely responsible for declaring and paying any taxes due on their commission earnings in accordance with the laws of their country of residence. The Guardians Tribe does not withhold taxes or provide tax documentation.

6.5 Fraud Prevention & Withholding of Payments

Withholding of Payments for Fraudulent Activity
The Guardians Tribe reserves the right to suspend or withhold any affiliate commission payouts if there is evidence or suspicion of fraudulent activity, referral abuse, violation of programme policies, or breach of account terms. Payouts may be delayed or forfeited while investigations are carried out, and accounts found to be in breach may be permanently removed from the Affiliate Programme.

Chargebacks & Refund Adjustments
If a referred membership is refunded, cancelled, or subject to a chargeback, the associated commission will be reversed and deducted from the affiliate’s future payouts. This ensures commissions are only paid on successful and completed transactions.

Review & Compliance Checks
Any affiliate accounts flagged for suspicious activity may undergo an internal compliance review before payouts are processed.

7. Additional Incentives

At this time, The Guardians Tribe does not operate any performance-based bonus programmes or incentive schemes within the Affiliate Programme or Refer a Friend Programme.

Earnings within the Affiliate Programme are based solely on the 20% commission earned from successful referrals and membership renewals, while rewards within the Refer a Friend Programme are limited to the one-time shared referral reward described in these Terms.

The Guardians Tribe reserves the right to introduce, modify, or discontinue additional incentives or promotional programmes in the future at its sole discretion.

8 Termination

The Guardians Tribe reserves the right to suspend or terminate a member’s participation in the Affiliate Programme or Refer a Friend Programme at any time if they are found to be in violation of these Terms and Conditions, engaged in fraudulent or deceptive behaviour, or acting in a way that harms the integrity of the platform.

Termination may result in the forfeiture of unpaid commissions, referral rewards, or membership credits, and the immediate cessation of any promotional activities related to The Guardians Tribe.

The Guardians Tribe also reserves the right to terminate programme participation for accounts that remain inactive for extended periods or fail to comply with programme requirements.

8.1 Grounds for Termination

A participant’s involvement in the Affiliate Programme or Refer a Friend Programme may be terminated for the following reasons:

Breach of Terms and Conditions – Any violation of The Guardians Tribe Terms & Conditions may result in immediate removal from the programme.

Fraudulent or Unethical Behaviour – Engaging in dishonest, misleading, or unethical practices, including false referrals, account stacking, or misrepresenting affiliation with The Guardians Tribe.

Abuse of the Referral System – Attempts to manipulate the referral system for personal gain, including the creation of multiple accounts, chargeback fraud, artificial sign-ups, or any activity intended to generate commissions, rewards, or referral credits improperly.

8.2 Consequences of Termination

Upon termination from the Affiliate Programme or Refer a Friend Programme, the following conditions apply:

Forfeiture of Unpaid Earnings – If termination occurs due to a breach of these Terms, any unpaid affiliate commissions, referral rewards, or membership credits may be forfeited and will not be issued.

Cessation of Promotional Activities – Members must immediately cease all marketing, promotional activities, and use of The Guardians Tribe branding. This includes removing referral links, affiliate links, banners, advertisements, or any other promotional materials.

Revocation of Access – Terminated affiliates will lose access to the affiliate dashboard, referral tools, and related programme resources.

Legal Action for Severe Violations – In cases involving fraud, abuse of the referral system, or serious misconduct, The Guardians Tribe reserves the right to pursue legal action to recover any losses or damages.

8.3 Appeal Process for Termination

If a member believes their termination from the Affiliate Programme or Refer a Friend Programme was made in error, they may submit an appeal in accordance with the following process:

Appeal Window – Members must submit a formal appeal within 7 days of receiving their termination notice.

Supporting Documentation – Appeals must include any relevant information or evidence demonstrating compliance with the programme rules and Terms & Conditions.

Review & Decision – The Guardians Tribe will review the appeal and issue a final decision within 14 business days of receiving the appeal request.

8.4 Reinstatement After Termination

Reinstatement of a terminated account is at the sole discretion of The Guardians Tribe and may be considered under the following conditions:

Issue Resolution – The member has fully resolved the issue or violation that led to their termination.

Commitment to Compliance – The member demonstrates a clear willingness to comply with the Terms & Conditions and the rules governing the Affiliate Programme or Refer a Friend Programme.

Protection of Programme Integrity – Reinstatement will only be considered where The Guardians Tribe determines there is no ongoing risk to the integrity, fairness, or operation of the programmes.

9. Confidentiality

As a participant in The Guardians Tribe Affiliate Programme or Refer a Friend Programme, members may receive access to confidential or proprietary information relating to The Guardians Tribe. This information is strictly protected and must not be shared, disclosed, copied, or used in any manner that could compromise the integrity, operations, or reputation of The Guardians Tribe.

9.1 Definition of Confidential Information

Confidential information includes, but is not limited to, the following:

Marketing Strategies – Campaign plans, promotional approaches, brand positioning, and marketing insights relating to The Guardians Tribe.

Sales Data & Financial Metrics – Referral performance data, commission reports, conversion metrics, and other earnings-related information.

Proprietary Tools & Systems – Internal software, operational systems, processes, and any exclusive training materials or resources provided to members.

Business Operations & Future Plans – Strategic initiatives, product developments, partnerships, expansion plans, or any business information not publicly disclosed by The Guardians Tribe.

9.2 Member Obligations

By participating in the Affiliate Programme or Refer a Friend Programme, you agree to:

Maintain strict confidentiality – Keep all confidential information secure and use it only for its intended purpose within the programmes.

Not disclose confidential materials – Do not share, distribute, or disclose confidential information to any third party without prior written consent from The Guardians Tribe.

Safeguard proprietary information – Exercise reasonable care and due diligence to protect proprietary information from unauthorized access, disclosure, or public exposure.

Report security concerns – Promptly notify The Guardians Tribe of any suspected breaches, misuse, or unauthorized disclosure of confidential information.

9. Confidentiality

As a participant in The Guardians Tribe Referral Program, members may receive access to confidential and proprietary information. This information is strictly protected and must not be shared, disclosed, or misused in any manner that could compromise the integrity of The Guardians Tribe.

9.1 Definition of Confidential Information

Confidential information includes, but is not limited to:

Marketing Strategies – Campaign plans, promotional techniques, and brand positioning insights.

Sales Data & Financial Metrics – Referral conversion rates, commission performance reports, and earnings data.

Proprietary Tools & Systems – Unique software, internal processes, and exclusive training materials provided to members.

Business Operations & Future Plans – Any strategic initiatives, product developments, or business expansion plans not publicly disclosed.

9.2 Member Obligations

By participating in the Affiliate Programme or Refer a Friend Programme, you agree to:

Maintain strict confidentiality – Keep all confidential information secure and use it only for its intended purpose within the programmes.

Not disclose confidential materials – Do not share, distribute, or disclose confidential information to any third party without prior written consent from The Guardians Tribe.

Safeguard proprietary information – Exercise reasonable care and due diligence to protect proprietary information from unauthorized access, disclosure, or public exposure.

Report security concerns – Promptly notify The Guardians Tribe of any suspected breaches, misuse, or unauthorized disclosure of confidential information.

9.3 Exceptions to Confidentiality

The confidentiality obligations outlined in these Terms do not apply in the following circumstances:

Publicly Available Information – The information becomes publicly available through no breach or fault of the member.

Legal Disclosure Requirements – Disclosure is required by applicable law, regulation, or court order. Where legally permitted, the member must notify The Guardians Tribe in advance of such disclosure.

Authorized Disclosure – The member has received prior written permission from The Guardians Tribe to disclose specific information.

9.4 Consequences of Breach

Account Suspension or Termination – Any breach of confidentiality may result in suspension or removal from the Affiliate Programme or Refer a Friend Programme.

Legal Action for Damages – The Guardians Tribe reserves the right to pursue legal remedies if unauthorized disclosure results in financial, operational, or reputational harm to the platform.

Forfeiture of Earnings – Members who violate confidentiality obligations may forfeit any outstanding commissions, referral rewards, or membership credits and may be permanently barred from future participation in the programmes.

9.5 Duration of Confidentiality Obligation

The obligation to maintain confidentiality continues beyond participation in the Affiliate Programme or Refer a Friend Programme. Former members remain responsible for protecting any confidential or proprietary information they obtained during their participation.

Upon termination or departure from the programmes, members must return or securely destroy any confidential materials, documents, or resources provided by The Guardians Tribe.

10. Intellectual Property

All trademarks, logos, branding, marketing materials, and proprietary content associated with The Guardians Tribe remain the exclusive property of The Guardians Tribe.

Members participating in the Affiliate Programme or Refer a Friend Programme may use approved branding and promotional materials solely for the purpose of promoting The Guardians Tribe in accordance with these Terms and Conditions.

No Transfer of Ownership – Participation in the Affiliate Programme or Refer a Friend Programme does not grant members ownership, licensing rights beyond permitted use, or any permanent rights to The Guardians Tribe’s intellectual property.

  • Trademarks, service marks, and logos
    • Marketing and promotional materials
    • Training content, videos, and proprietary guides
    • Website design, text, graphics, software, and multimedia elements

10.2 Permitted Use of Intellectual Property

Non-Exclusive, Revocable License – Members participating in the Affiliate Programme or Refer a Friend Programme are granted a limited, non-exclusive, non-transferable, and revocable license to use approved marketing materials solely for the purpose of promoting The Guardians Tribe.

Acceptable Uses Include:

  • Sharing official marketing materials provided by The Guardians Tribe
    • Using approved logos, graphics, and banners for promotional purposes
    • Directing traffic to the official The Guardians Tribe website using approved referral or affiliate links

Usage Conditions:

  • Marketing materials must not be altered, rebranded, or modified without prior written consent from The Guardians Tribe.
    • Members must clearly represent themselves as independent participants and not employees, agents, or official representatives of The Guardians Tribe.

10.3 Prohibited Uses of Intellectual Property

Legal Action for Infringement – The Guardians Tribe reserves the right to pursue legal action where necessary to protect its trademarks, brand assets, and intellectual property.

Forfeiture of Earnings – Members found in violation of these intellectual property terms may forfeit any outstanding commissions, referral rewards, or membership credits and may be permanently barred from future participation in the programmes.

11. Indemnification

By participating in the Affiliate Programme or Refer a Friend Programme operated by The Guardians Tribe, you agree to indemnify and hold harmless The Guardians Tribe, its founders, officers, employees, partners, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your actions or conduct while participating in the programmes.

No Financial or Legal Responsibility – The Guardians Tribe shall not be held liable for any financial loss, reputational damage, or legal consequences arising from a member’s individual actions while participating in the Affiliate Programme or Refer a Friend Programme.

No Guarantee of Earnings – Participation in the Affiliate Programme does not guarantee any specific level of income or financial results. Earnings depend entirely on individual effort, activity, and the successful referral of new members.

No Responsibility for Third-Party Disputes – Any disputes between members, referred individuals, or third parties must be resolved independently and without liability to The Guardians Tribe.

11.3 Consequences of Breach & Legal Enforcement

If a member fails to uphold their indemnification obligations under these Terms, the following actions may be taken:

Suspension or Termination – The Guardians Tribe reserves the right to suspend or terminate participation in the Affiliate Programme or Refer a Friend Programme for members whose actions pose a legal, financial, or reputational risk to the platform.

Forfeiture of Earnings – Any unpaid commissions, referral rewards, or membership credits may be withheld or forfeited if a member’s actions result in claims, damages, or legal exposure for The Guardians Tribe.

Legal Proceedings – Where necessary, The Guardians Tribe reserves the right to pursue legal action to recover losses, enforce these Terms, or prevent ongoing violations.

12. Limitation of Liability

By participating in the Affiliate Programme or Refer a Friend Programme operated by The Guardians Tribe, members acknowledge that The Guardians Tribe shall not be liable for any indirect, incidental, consequential, or special losses arising from their participation.

This includes, but is not limited to, losses relating to referral activity, promotional efforts, platform usage, or expectations of earnings.

This limitation of liability ensures that The Guardians Tribe is not held responsible for circumstances beyond its reasonable control and helps maintain a fair, transparent, and sustainable programme structure.

12.1 Scope of Liability Limitations

The Guardians Tribe shall not be held responsible for any of the following:

Indirect, Incidental, or Consequential Damages – This includes any unintended or unforeseen losses arising from a member’s participation in the Affiliate Programme or Refer a Friend Programme.

Loss of Income or Profits – The Guardians Tribe does not guarantee any specific earnings. Any financial loss resulting from marketing performance, referral activity, external factors, or lack of participation remains the sole responsibility of the member.

Technical or Administrative Delays – Commission payments may occasionally be affected by technical issues, banking delays, system maintenance, or administrative reviews. Such circumstances do not make The Guardians Tribe liable for delayed payments.

12.2 No Guarantee of Continuous Access

The Guardians Tribe strives to provide a stable and reliable platform, however it does not guarantee the following:

Uninterrupted Programme Access – Occasional downtime may occur due to system maintenance, security updates, technical issues, or other operational requirements affecting the Affiliate Programme or Refer a Friend Programme.

Error-Free Functionality – While every effort is made to maintain accurate systems, occasional errors may occur in referral tracking, reporting, account balances, or payment processing.

Future Earnings Potential – Earnings within the Affiliate Programme depend on individual participation, referral activity, market conditions, and programme policies, all of which may change over time.

12.3 Exclusions from Liability

The Guardians Tribe shall not be held liable for any losses, damages, or disruptions arising from the following circumstances:

Acts of Third Parties – Including fraud, hacking, service outages, payment processor failures, or actions taken by external service providers beyond the control of The Guardians Tribe.

Understanding the Risks – Members voluntarily participate in the Affiliate Programme or Refer a Friend Programme and acknowledge that they accept any risks associated with their participation.

Complying with Policies – Members are responsible for complying with these Terms & Conditions and ensuring they meet all eligibility, legal, and programme compliance requirements.
